The General Directorate of Industrial Property (GDIP) of the Republic of Albania implements CP9
Today the General Directorate of Industrial Property (GDIP) of the Republic of Albania published a practice paper in relation to the distinctiveness of three-dimensional marks (shape marks) containing verbal and/or figurative elements when the shape itself is non-distinctive in itself.
The publication of this practice paper is the outcome of the combined effort of the GDIP and the EUIPO on finding common grounds with the criteria listed under the common communication
distinctiveness of three – dimensional marks (shape marks) containing verbal and/or figurative elements when the shape is not distinctive in itself (CP9). The principles of the practices will be generally applied and aim to cover a large majority of cases.
The document, developed within the framework of these entities’ international cooperation activities, aims to increase clarity, transparency, legal certainty and predictability for the benefit of the users and examiners of the IP Offices. It also intends to be a reference for these and all other interested parties.
The practice paper provides a clear and comprehensive explanation of the principles on which the practice is based. It will be generally applied by the GDIP and the IP offices of the European Union Intellectual Property Network (EUIPN).
The practice paper can be found below both in Albanian and English. The documents are divided into two parts. The first summarises the key messages and statements of the practice principles. The second part provides a clear and comprehensive explanation of those principles.

Drejtoria e Përgjithshme e Pronësisë Industriale (DPPI) e Republikës së Shqipërisë, publikoi ditën e sotme një praktikë, në lidhje me dallueshmërinë e markave tredimensionale (markave të formës) që përmbajnë elemente verbale dhe/ose figurative kur vetë forma, nuk është dalluese në vetvete (CP9).
Publikimi i këtij dokumenti, vjen si rezultat i përpjekjeve të përbashkëta të DPPI dhe EUIPO, për gjetjen e bazave të njëjta, me kriteret e listuara, sipas komunikimeve të përbashkëta – dallueshmëria e markave tre-dimensionale (markat e formës) që përmbajnë elemente verbale dhe/ose figurative, kur forma nuk është dalluese në vetvete (CP9). Parimet e këtyre praktikave, përgjithësisht do të gjejnë zbatim, dhe synojnë të mbulojnë një pjesë të madhe të rasteve.
Dokumenti i zhvilluar në kuadër të aktiviteteve të bashkëpunimit ndërkombëtar, të këtyre entiteteve, synon të rrisë qartësinë, transparencën dhe juridike në favor të përdoruesve dhe ekzaminuesve të zyrave të PI-së. Ai synon gjithashtu, të jetë një referencë, për të gjitha palët e interesuara.
Ky dokument, ofron një shpjegim të qartë dhe gjithëpërfshirës të parimeve mbi të cilat bazohet praktika. Ai do të zbatohet përgjithësisht nga DPPI dhe zyrat e PI-së të Rrjetit të Pronësisë Intelektuale të Bashkimit Evropian (EUIPN).

Drejtori i Përgjithshëm i Pronësisë Industriale, znj. Ledina Beqiraj, në cilësinë e Project Leader të këtij projekti, evidentoi realizimin e objektivave si dhe forcimin e marrëdhënieve ndërinstitucionale sipas fushës së përgjegjësisë.
Patëm gjithashtu kënaqësinë që pjesë të panelit folës të kishim z. Enzo Damiani, përfaqësues i European Union Delegation në Republikën e Shqipërisë dhe znj. Veronika Korkaj, Drejtor i Përgjithshëm i CFCU.
Projekti i Binjakëzimit është zbatuar kryesisht online për shkak të situatës së shkaktuar nga pandemia COVID-19 në veçanti përmes trajnimit të të gjitha strukturave dhe aktorëve të përfshirë në këtë proces.

BACKGROUND INFORMATION
Contract objectives and expected results
Provision of services as Assistant to the Resident Twinning Advisor (hereinafter “RTA”) under the Twinning Project AL 17 IPA FI 01 20 “Strengthening the Protection and the Enforcement of Intellectual Property Rights” with the objective of supporting the Republic of Albania in aligning the standard of protection and enforcement of Intellectual Property Rights with EU Best Practices in order to effectively conduct accession negotiations and successfully manage overall EU integration and pre-accession assistance.

SCOPE OF THE WORK
RTA Assistant will provide administrative support and accounting assistance to the Resident Twinning Adviser (RTA) and Twinning Partners during the whole duration of the Twinning Project and, in particular, support the effective delivery of the Twinning Contract mandatory results, ensuring a good flow of communications and coordinating the different Twinning partners; administrative support on a daily basis to the Member State`s experts involved for short-term working missions to the Beneficiary Country within the Project’s framework.
He/she will also provide linguistic assistance (interpretation and translation), in Albanian/English, during the implementation of the Twinning project.
He/she will work under the supervision of and report to the RTA.
